Morocco Unveils Draft Law to Regulate National Carbon Market

A draft bill establishing Morocco’s legal framework for climate action and carbon market regulation is now open for public consultation on the website of the Secretariat-General of the Government. The draft law on climate change and carbon market regulation aims to give the Kingdom an integrated legal framework covering all aspects of climate action, strengthening coordination among stakeholders and ensuring reliable, transparent climate data.

The text is designed to support Morocco’s commitments under the UN Framework Convention on Climate Change and the Paris Agreement, while adapting national law to recent developments in the global climate regime — notably strengthened transparency requirements and the cooperation mechanisms under Article 6 of the Paris Agreement. It sets out legal foundations for Morocco’s participation in international carbon markets, including approval procedures for emission-reduction projects and transfer rules, while avoiding double counting.

A key feature is the creation of a ‘National Carbon Market Registry,’ an electronic platform that would register greenhouse gas emission-reduction projects, related implementation and transfer authorizations, and track the issuance and ownership of carbon units to prevent double counting. The registry would also centralize data on bodies responsible for validating and verifying internationally transferable mitigation results.

The draft law further establishes a national accreditation system for validation and verification bodies, defining conditions for granting, suspending or withdrawing accreditation. The aim is to guarantee these bodies’ independence and technical competence, ensure compliance with applicable standards, and reinforce the credibility of carbon-project verification processes.

If adopted, the government says the law would complete Morocco’s national legal framework for climate governance, strengthen transparency and coordination among stakeholders, and allow the Kingdom to capitalize on opportunities offered by international carbon markets — while boosting its attractiveness for climate investment and supporting its national and international climate commitments.
